Can you sue your employer if he is paying u $9.99 and has all the other employees at $10.00 when he stated before he hired me that he starts off at 10.00?

IF you can prove you were hired at $10, then you could file a lawsuit or a wage claim through the Labor Commissioner for the unpaid amount, plus interest and penalties. Based upon $.01 differential in pay, you don't have much of value in such claim. Go talk to the employer to resolve this.
