Legal Question in Employment Law in California

I have taught at a private elementary school for 6 years. My reviews are always stellar. Parents and children compliment me to the school and stay in the school because of me.

Last summer, the school was purchased by a church. I just found out that, during the next school year, the school will take on a Christian identity.

I was informed that I will not be asked back, after this semester, solely because I am Jewish.

Can they do that?

Unfortunately, yes. It is not as if you're being fired. Your contract is not being renewed.

Actually, this is very interesting. I would not consider this an open and shut case without doing a little research. Even employment at will, which says you can be terminated for any or no reason, doesn't allow you to be terminated for a bad reason, such as religion. The church receives a lot of tax benefits from the government, and probably has nondiscrimination obligations. Please call me for a free consultation to discuss a variety of options.

Yes. Churches and church schools are specifically allowed by CA law to discriminate in favor of their religion. Why should it be any other way when the whole point of the school is them teaching their religion? On your point; Hebrew schools do not hire Christians.
