Legal Question in Landlord & Tenant Law in California

tenant eviction

i am going to sell my house and i asked two of my tenants to return me my house. one of them said yes but the other one that is staying in my garage, that doesnt have permits is saying he is not going to move until i give him three months notice or three free months. he said he is going to call inspection on me because of my illegal conversion on my garage. he has only been renting from me for only three months, he is on a month to month agreement. i am giving them 45 days to move out with the last month free. what can i do to get rid of him, am i suppose to give him any free time? thanks

Re: tenant eviction

Give him a 30-day notice to quit. If he doesn't, file an eviction lawsuit (unlawful detainer) in court. Or, pay him off to move sooner.
