Legal Question in Legal Ethics in California
My wife was having an affair with a married attorney [father of ten].I only uncovered this after retaining a P.I. After recieving this horrible news i contacted this mans wife by phone.She was receptive to my contact and was most helpful in filling in the blanks.She told me i could call her anytime.Days later i was served a restraining order listing my wife as the plantiff and listing her lover as her legal counsel.I was threatened by her lover/attorney stating "im coming after you for talking to my wife".I retained legal representation and apeared at the hearing.My wife was not present only her lover/attorney.I was able to repel this R.O. CLETS order only after agreeing to a one year stay away order. Thirty people were listed on this document,people i have never heard of or met. What ethics and or conflict of interest existed. This man has sat as a judge pro tem and teaches law at two of the local universities.I thank you for you time and response.This has bothered me for some time....

You have related immoral conduct, but there is no conflict of interest because he was representing your wife who he had no conflict with. You can report him to the State Bar because attorneys are not supposed to sleep with their clients.
