Legal Question in Medical Malpractice in California
Refusing to put on lifesupport
I was 23 weeks into my pregnancy and in labor. I arrive at the hospital as soon as they find out im 23 weeks pregnant they tell my dad my husband and I that they do not try to save babies that small. I begged them to perform a c-section and to put my baby on the ventilator to try and keep her alive they just reffused. They induced my labor and my daughter was born they just handed her to me and walked out. She took her last breathes in my arms. Is there anything that can be done, I know my baby will be here no more but I would not want her death to be left forgotten.

Before I can determine whether I can assist you in this matter, I need more information. For example: The date of your delivery; the name of your OB; the hospital involved; the birth weight of your baby; the reason for your early onset of labor; whether any efforts were taken to stop the labor; etc.
Please give me a call if you would like to explore this matter further.

Any medical malpractice claim like this depends entirely upon testimony from independent medical 'experts', i.e. doctors. In order to get an intelligent opinion whether there are grounds for a suit, you will have to get the medical files and witness statements from those involved reviewed by an expert and your attorney. While it sounds terrible what happened, you have a lot to accomplish before deciding to take action. I would be happy to help you in this, contact me if interested.
