Legal Question in Personal Injury in California

Small Claims-Bodily Injury

How much approximately should one expect to receive as a settlement for bodily injury(back spasms due to a hard fall) from a major retail chain without retaining legal counsel?

Without legal counsel $0. Why would they give you anything unless there is an attorney fighting for your rights who will make them pay much more in court unless they settle? Many people often make the mistake of trying to save money on their attorney first. Consult an attorney now.

I respectfully disagree with the other two attorneys. I believe that you will received something - perhaps a night out at a Dennys restaurant.

Those who try to circumvent the experience and talents of an attorney in order to save on paying legal fees usually end up saving the defendant more money at the end of the day. Depending on where you are located, feel free to contact my office for a free consultation at 818.385.0520.

Re: Small Claims-Bodily Injury

You may receive a settlement from the store; however, the truth is that personal injury victims who represent themselves do not receive close to as much as they do while represented by an attorney. Your injuries sound serious and may require medical attention for years to come. Not to mention time off from work, etc. Why guess as to how much all of that is worth? You only have one chance at being adequately compensated. If you take a low settlement but then develop complications later, you will not be able to renegotiate or file suit. I would suggest speaking with an attorney to see how strong your case is and hiring one that you feel comfortable with. If you have a good case there will be many attorneys who will agree to represent you on contingency. If you would like to speak with me about your injury, feel free to contact me. I would be happy to at least point you in the right direction.

Yours truly,

Bryan

You'd be lucky to get your legitimate medical bills repaid, if it is a valid claim. Counsel might be able to do better, but without permanent damage and disability, the case has quite limited value.
