Legal Question in Personal Injury in California

Summary Hearing / Holding Over

I have a summary hearing coming up I am the plaintif. I filed pro-per. I live out of the county the accident occured. I had an attorney here and at the last minute he dropped from the case, stating that there was not enough money for him to travel the distance needed for depositions etc... I submitted a letter of demand to both defendants ins. and atty. they inturn sent me a summary judgement hearing.I now need time to go and spend in that town and find a atty there.so I have to go into this summary hearing to get it held over till I can find an atty. Can you give me some advice on how to do this? No depositions have been taken. There has been no trial date set either. Any advice on this would be greatly appreciated.

Re: Summary Hearing / Holding Over

Since you will not say what town the case is in it is difficult for anyone here to help you.

The fact that no discovery has taken place yet can be grounds to defeat a summary judgment but you cannot just show up at the hearing and say that. you must file a proper written response well in advance of the hearing or you will lose. you better get moving.
