Legal Question in Product Liability in California

Advertizing Products

A Company in Califonia started calling me with advertizing gimmicks for the salon. I ordered from them a few times from the discription of the product over the phone, (Pens,Magnets, ect.)As time went on the products started getting cheaper in quality ,When they would call and ask if I was saticfied I would tell them no and they would make it up to me by sending something out that I had been happy with.I decided to give them one more try and was very dissaticfied with the product. It was sent C.O.D. so I stopped payment and sent the products back. This was last year. They are now Harrassing me at work and at home. They will call the salon and ask if I have money in my cash register and say '' You owe us money and we want it.'' They leave messages saying to have my Legal representitve call them back. I don't have thier product and don't feel as though I owe them anything. DO I?

Re: Advertizing Products

No you don't. If they keep harrassing you, I suggest you have an attorney write them a letter.

If would like us to write a letter for you, please e-mail me with contact information and detailed facts. Our charge to write the letter is $100.

Good luck and thank you for the inquiry.

Re: Advertizing Products

If you returned the package to the cosmetics company then you're probably not obligated to pay for the product. Some companies will charge a "restocking fee" for products which are returned without some kind of authorization (referred to as Returned Materials Authorization), I'm wondering whether this company is seeking payment in full for the returned items, or just a restocking charge of some kind.
