Legal Question in Traffic Law in California

My nephew had an accident while driving alone in my car

I gave my 17 year old nephew permission to drive my truck. He has an instruction permit which requires another licensed driver to be present with him while he drives; he did not have such a driver present and had an accident when he fell asleep at the wheel. Only property damage was involved. During my research of the law on fastcase.com, I found I am liable under statuatory law, case law and common law. My question is:

What defense(s) might I assert to limit my liability because the claimant's insurance company has made a claim against me? Is it true that the statuatory maximum that claimant can recover for property damage is $5,000?

There's no limit to your liability. Look up "negligent entrustment."
