Legal Question in Wills and Trusts in California

Trust versus will, which should I use?

I have been divorced for--name removed--number of years, have three grown children. Besides--name removed--few thousand dollars my only assets are--name removed--half interest in my home. My daughter owns the other half. I want to pass on those assets with as little trouble as I can manage. Also, I wonder if there is anything I can do to protect my shildrens inheritence from being eaten up by my health costs.

If you have interest in a home, your best bet would be a trust. Regarding your health cost concerns, you may need to take another approach, depending on your age and current health situation.

A family trust will serve your needs best. There are additional transfers and subtrusts that can be created (based on the initial trust) that can each have the benefits you describe.
