Response to Deposition

The insurance company denied my workmans comp claim. We went to a deposition. How long do they have to respond to the deposition.

If the insurance carrier has already taken your deposition and you are not represented, you are at a great advantage. You need to find out why the carrier denied your claim. Also you need to file an application.

At this point you need help. I would call the Inforamation and Assistance office at the WCAB and ask for the I&A officer. If the officer cannot assist you, ask the WCAB clerk for a listing of Panel attorneys. Just because the claim is denied, does not mean you do not have a good claim. It may be that the insurance carrier had no coverage at the time of your injury.

There is no particular time for your employer to respond to a deposition. However, the employer does have 90 days from the time your submitted your claim form to decide whether to accept or deny your claim. It appears that they already decided to deny your claim.

The chances of your deposition turning your claim around is zero to none. YOU NEED IMMEDIATE REPRESENTATION!
