Has a law been broken if email is intercepted while in transmission?

I have proof that emails that I am sending to a private party are being opened by an unauthorized individual BEFORE the intended recepient is opening them. First, can someone tell me specifically in the state of Colorado (or federally) what law violations I can use (or the intended email recepient ) to file a court case? I know that there is the email interception that applies to only data that is still in transmission. I have found several cases that were dismissed based on the facts that the intended recepient of the email had already opened the emails prior to the unauthorized person opening them. Based on the judges belief that the email was no longer in transmission- therfore not a violation of the wire tap? act. In my case, I have solid evidence that the emails are being opened by the unauthorized person first. Does anyone know of a court case that I might research to see if it is similar to my situation? Also- does anyone know of a lawyer in the Denver metro area that works on computer law cases such as these? Thanks so much for your time!
