Legal Question in Criminal Law in Colorado

Theft Fraud

I am wondering what the maximum sentence could be for a person with no record no prior offenses charged with theft in the amount of 3000.00 and fraud signature on paychecks.

Re: Theft Fraud

Without knowing more about the charges and the circumstances, all I can advise you of at this point is that forgery in Colorado under Section 18-5-102 is a class 5 felony with a maximum punishment of three years imprisonment. A theft charge under Section 18-4-401 involving a value of more than $500 but less than $15,000 is a class 4 felony and the maxmimum on that charge is six years imprisonment. That is not to scare you but to let you know the actual maximums here. As an individual with no prior record, you may be eligible for probation with no jail time and restitution (paying back the money) but the prosecutor is likely to want a plea to a felony. There is a possibility depending on the circumstances that another arrangement can be worked out between your attorney and the DA for a deferred prosecution or sentence where if you stay out of trouble, pay back the money, you will have no actual conviction on your record. That would depend on the circumstances, the DA in the court you go to and your lawyer. Feel free to call me at (303) 549-1953 should you have any further questions. Good luck!
