Alimony

My fiance was divorced in the state of CT and pays alimony to his ex wife. She is now in prison. What is his legal obligation as far as alimony goes?

The alimony order is in effect until she or he dies, she remarries (unless the order continues the alimony even after she remarries, which is unusual) or until the order expires by its own terms. Usually there's a time limit in the order, like five years or something. He can go to court and seek a modification based on substantial change in circunmstances (which there certainly is here) but it's possible that the state will object to the modification and try to collect the money to pay for her incarceration. In the past, I would have said that the state wouldn't even notice, but these days, what with the deficits and all, it is a risk.. He's got nothing to lose by trying, though. All they can do is say no.
