What is legal separation from your spouse, and when would you want to be in that situation ?

Generally, most people are not interested in a legal separation today because there is no purpose. Many times, if the parties are beyond their retirement years, this may be an option because they share medical care issues that are tied into their assets.

In other situations, and very few at that, some people may not want a divorce without entering into an agreement that spells out their marital affairs in a legal separation for a period of time to see how it works. Sometimes this is an option for a particular set of facts.

It may be an option and it may not be. One would have to look to the particular facts of the case to make that judgment call.
