Legal Question in Civil Litigation in Connecticut

5 year on-going suit, Pre-Trail question

My husband had a 22ft. fall siding a house in a new allotment 5 yrs. ago. No ''back fill'' was done as promished by the main contractor. My husband substained ''grade 3 blowout'' of the right knee, surgery and therapy followed. Also, a back injury, sprain, so we think. He has developed ''Fibromylasia'' from his injuries.

We have no idea of the dollar settlement we're looking at or when the Pre-Trial conference is, our attorney does not return phone calls well. What is the normal process? Does it take this long? What kind of settlement should we exspect?

It can take that long, however, therer is no excuse for not hearing from your lawyer. Remember, you can change attny's whenever you want. YOu may want to remind your lawyer of that. If you need a refferal, let me know where you are in the State

I can't tell from the information in your message whether your matter is pending in Connecticut or Ohio. If it is Connecticut, five years is quite a while for most of the judicial districts. Most move more quickly than that. If the suit was brought close to the two year statute of limitation, then two years would have already gone by. If your husband's treatment went on for a long time, that can extend things. The Connecticut Judicial Branch has a great web site where you can find your case and see what has been happening from a pleadings point of view. It does seem unusual that you would not have had a pre-trial or two before now. Have depositions been done? Your attorney should be speaking with you about the value of the case. No attorney, who has not seen the file, can give you a valuation of the case. Beware of any who do. Good Luck. Any other questions, let me know.
