Legal Question in Civil Litigation in Connecticut

Threats to sue for defamation

january 2005 I emailed an administrator of a website messageboard, telling of my experience with a guy that they were ridiculing on their website. I did not want to post it myself fearing that he will find me again (he basically stalked me) I said this guy was psycho and crazy (and cited personal examples) The administrator posted my email, under his username.

Now i am being threatened with a lawsuit of defamation of character. Does he have a case if

1. It wasn't posted under my username but rather the administrator's

2. if what i said is true

3. if it was posted almost 4 years ago (statute of limitations).

He has found me again, and is threatening to sue me regarding this. does he have a case? I live in CT, he lives in PA, I lived in NJ in 2005.

Because he hasn't threatened to hurt me, I haven't been able to get a restraining order, or order of no contact, etc...

Re: Threats to sue for defamation

First of all I do not practice in NJ or PA. I can only tell you that in CT, the statute of limitations for defamation is two (2) years. I can not advise you on which law would apply.

Truth is an absolute defense to defamation. I'm not sure it's relevant that your email was posted under the administrator's name.So long as you "publish" to a third party then that is sufficient. You wrote the letter.

However, assuming CT law applies, he may be too late.
