Dui

I had a dui a number of years ago ,i went to court was put on probation, ,i left florida ta move back ta pa ,without doing anything about my obligations to florida, now their suspending my pa liscense untill i resolve my florida charges ,what will i have ta do ta resolve this matter

Hello: I read your quest. and the two responses. I can offer some more specifics. I am handling a case just like this right now. Usually, there is a warrant issued for a violation of probation. I would first contact the probation dept. and get a list of what still needs to be done. I usually ask my client to get busy completeing those things.

At the same time, I contact the court and ask the judge to withdraw the warrant, which is called a capias, and put the case on the calendar for a pre-trial. This is only a status conference. At that time I show up and tell the court what we are doing and get the case passed for another pre-trial. We can do this a few times to stall and allow my client to complete the ordered activities. While in court, I ask the assistant state attorney and the court what type of sentence they are seeking. Usually, if we have everything completed, probation is simply terminated and there is no further sentence. If the person had gotten arrested on the capias before hiring me, there may be a couple of days of jail time which would be part of the sentence as time served.

I add that these procedures are common in the various counties in North Fla. and may not be exactly the same in other counties. Also, sometimes the court will not recall the capias until we show up in court. In that case, I tell my client to lay low until court. Since you are out of the state, that may not be a concern to you.

You have to deal with PennDOT here if you are going to have a Pennsylvania license. You can only have a license for one state. There is a set of laws called the Interstate Drivers License Compact that apply to this situation.

Since you were put on probation and did not report there is most likely a Florida violation of probation filed and a warrant for your arrest. I can't be sure without checking with the appropriate county's clerk.

Depending on what stage this possibe violation of probation is in; you will most likely have to come back to Florida. That being said, I wouldn't come back without checking with an attorney first; because you might be taken into custody when you get here.
