Will having a Nolle Prose adjudication for a misdemeanor bar a non citizen, non

my friend has a f2 student visa and was arrested for retail theft 2 years ago. He did a pre trial intervention programme by attending some classes and doing 12 hours of community service. the case was then Nolle Prose. With reason given stating ''completed plea and pass''. My friend was told that he would not have any problems travelling into or out of the U.S. and he hasnt had any problems to date as he has reentered the country on 3 occasions without any incident. With the new fingerprinting process that is now taking place at the airports and new tougher rules that i have heard have been put in place would my friends arrrest and subsequent Nolle Prose bar him from reentering the U.S under the new guidlines? He is due to return to the U.S on tuesday.

HIs arrest did not result in a conviction if he did not enter a plea, which is what most of these pretrial programs invol;ve. Just have him carry a certified copy of the disposition (showing Nolle Proesequi) as well as a copy of the law. Of course, any attorney would charge you to reserach and obtain same.
