If I'm being evicted for non payment can the landlord take my security deposit? Even if the are taking me to court to get there payment

Eviction and collection are two different actions. Eviction is removal for non payment. Collection is an independent action for past due monies AND potentially for damages. The security deposit is normally for damages, but depending on the lease it may be forfeited for failure to pay rental as well. You need to review the lease.
