Legal Question in Legal Malpractice in Florida
Attorney malpractice
I hired an attorney to file the proper paperwork on my construction lein in accordance with the 1 year requirement. I filed the lein when the owner didn't pay me. The attorney filed the case 5 days late. Do I have a malpractice case or do I have to pursue the breach of contract suit first.

You have to pursue your claim first and then see what if any damages you have. In the meantime, though, you may want to go to the Florida Bar website and file a grievance agaist your former attorney.
