Legal Question in Disability Law in Georgia

Layed off while on Short-term disability

Can you be layed off while on short-term disability? The short-term disability was for 6 weeks for a hysterectomy. I have been at the company longer than some employees in my department who were not layed off and feel that I was chosen because of my disability.

Re: Layed off while on Short-term disability

In most circumstances, a company may lay off an individual regardless of whether or not that person is on disability. However, a company cannot lay someone off BECAUSE of a disability. If you feel you were singled out because of a disability, consult with an attorney or file a claim with the EEOC.
