Contractor wont pay sub on time

My small construction company has been working for this company for a few months now, and they have pulled this once before. We are now finishing a project that the owner himself owns, so we gave him a good deal. But... when the time comes to pay the invoice... he ignores us, and acts like he doesnt know whats going on. For instance,

I send his secretary a invoice every week for work completed, and usually I email her to find out when our check is avail. (which is a few days, usuallly fri, send in invoice on Mon) and that is that. But, he has not pais us at all for the last weeks' check, and when i emailed sec., she wrote, ''Bob has not approved check, check back later''

Is this legal for him to hold payment of work completed until whenever he wants?

The terms of the project contract will apply to the situation. If there is no written agreement (or no verbal agreement recognized by both parties), it will be a little tougher to hold them to a specific payment deadline. However, either way, they should pay within a reasonable amount of time from the completion of the project. Have an attorney send them a demand letter, which my resolve the matter without litigation.

Yours is not a unique problem. Consult with a local attorney about filing a lien.
