Legal Question in Credit and Debt Law in Georgia

Buy here, pay here

I bought a car from a buy here pay here auto lot, and I no longer need the vehicle because my credit history improved and I can have a car financed by a bank now. If I was to turn the vehicle back in to the buy here pay here place, can they sue me or garnish my wages for the entire price of the car even though they will just clean the car and resell it?

What do your documents say? Most likely, you owe the full amount of the loan balance, plus their expenses, less what they can get for the car. More importantly, it makes little sense that you mention your improved credit, and in the next sentence indicate a desire to trash it again.

If you give back the car, you will ruin your credit (it shows as a repossession). If they sell it at an auction at a loss, you can then be sued (and later garnisheed). Often, when you add legal fees and repo fees your balance will be more than it was when you had the car.

Either keep the car until you pay it off, or consider trading it in on a car (often a bad deal since you'd roll over your upside down equity).
