Legal Question in Credit and Debt Law in Georgia

filing a timely response

I was served on 3/31 /07 which was a Saturday I filed my answer to complaint on 5/1/07. Was I late in doing so or did I have that extra day because I was served on a weekend?

Re: filing a timely response

You were late. You had 30 days from the service date, and the weekend was irrelevant.

However, Georgia allowed you 15 days to reopen the default. If, when you filed teh answer, you also paid the court costs, then the answer is treated as timely.

If you failed to do that, your answer can be dismissed. If you have not yet done so, you MAY (and this is not guaranteed) salvage things by paying the costs before an objection is filed.

The costs will vary by court and usually will be around $110.
