Legal Question in Credit and Debt Law in Georgia

keeping money

After calling and writing a credit card co about an erroneous payment on my account, and the credit card co promising to remove the amount from my now negative balance, they instead sent me the check for over $2000. I have been holding it for 7-8 months and they have not asked for it back yet. At some point can I legally keep and spend the money? If so, when?

Re: keeping money

If I read correctly, you got a $2,000 payment by mistake. If so, I am not sure why the solution is not clear -- call them, notify them of the mistake and send it back. I can't imagine keeping $2,000 that is not mine for 7 days, much less 7 months. Many people would do so without getting to he "legal" issues.

Follow Scott's answer to you. You should have returned the check, uncashed, as soon as you received it.
