Legal Question in Criminal Law in Georgia

Probation Violation

My hunsband was arrested on a probation violation due to unpaid fees. The probation started in 1998. He was sentenced to prison in 1999 and was released on September 28, 2001. The warrant he was arrested for was taken out in the year 2000. He could not pay fees while in prison. What do I need to do they will not release him on a bond right now he has been there since Friday.

Re: Probation Violation

Unfortunately, being in prison didn't stop his responsibility for fee payment. I know this does not make sense but it is a glitch in our system. They will not issue him a bond since he is in jail now on a probation hold. Most likely what will need to be done is to find out what unpaid fees he still has and pay them. There may be more involved (especially if you are dealing with Chatham county) such as undone community service, rehab or other such programs. There may also be a problem with non-reporting. I would suggest calling an attorney and having them help you navigate this problem.

Good luck
