Legal Question in Family Law in Georgia

I am 17 am just gt married Nov. 18. My husband and I got in a physical fight and the police were called. I was charged with Family viloence, simple battery, and criminal trespassing(damage to property). When I was arrested, I was not read my rights. I have not went to court yet and don't have anyone to represent me so they can let the judge know that my rights were not read to me? Can I get my charges dropped if I have a lawyer and he lets them know that my rights were not read to me?

Many people think that when you are arrested you must be read your rights. That is NOT required.

The only thing that happens if you are not read rights is that statements you might make after arrest are not admissable.

Good police do read rights just in case you suddenly want to confess, but it doesn't matter if your rights are read otherwise.

You do need a good lawyer before going to court.

You need a lawyer with these charges, no matter what the responses are here. You are facing serious charges that could affect your entire adult life for years to come. Get one now, on your own or a court appointed lawyer. To answer your question, not having your rights read is not an automatic dismissal. It just means certain statement you made may not be admissible in court. The prosecutor may have plenty of evidence without any statements from you. Your lawyer will discuss with you.

you have to engage a lawyer else police can prove your charges in absence of your lawyer and your lawyer will guide you also.

Regarding reading of your rights is not their duty but police cannot refuse you if you ask to talk to your lawyer or any person concern.

Good luck.
