recover legal cost

ex wife has filed for motion to change joint custody agreement she is seeking full custody. She has no grounds to seek this change. My son is almost 14 and can make his own decision in this matter. Can I counter sue for my legal expenses

Your son does not have an automatic right to select which parent that he wants to live with; however, once he reaches age 14 the court will give consideration to his preference. Therefore, it will be to your advantage to retain legal counsel for any challenge to custody. Any party can petition the court for legal expenses. Your question implies that you in fact will have legal expenses, i.e., that you are going to hire an attorney. Therefore, even though my opinion is that you may well recover actual legal expenses, I would, in the end, defer to the opinion of your attorney. He/she will be in a better position to guage how your local judges view the issue.
