visitation

I have custody of my children all under age 9.My ex- wife has visitation every other weekend.On her visits she stays at motels with her boyfriend or with her alcholic mother the children sleep on the floor and she has brought them home early because her parents which she lives with are constantly fighting.She has no phone or car and I am concerned about thier safety is ther a law that states I can withhold visitaion until she gets her life more stable.She is also on probation for writing bad checks and does not pay child support.

Generally, you can only withhold visitation if there is the threat of immediate harm to the children. If you feel this is the case and withhold visitation, be prepared for her to file a contempt of court petition against you. As a pre-emptive measure, if you feel the situation warrants denying visitation, you should consider filing a petition to modify visitation. Consult a local attorney.
