Legal Question in Employment Law in Georgia

Given A Hard Time For No Apparent Reason!

I recently suffered a heart attack (Jan.08). Subsequently, I was hospitalized & went through a surgical procedure to help the condition. In conversation with my Doctor with regard to aftercare and recovery, we discussed ways to cut down stress. Telecommuting was an option my Doctor suggested. Knowing that this is done is several other dept's at the company for which I work, I requested to telecommute one day a week (I have a 42 mi. commute - 1 way - every day in heavy traffic). My Mgr. asked for a Dr's note stating that this was necessary. Other employees in other dept's are OFFERED this option. After giving the Dr's note to my Mgr., I asked when we can finalize this and was told that she would need to speak with our HR Dept. I have an excellent (documented) track record with this company and don't understand why they're giving me such a hard time about this. I even chose a day of the week that doesn't interfere with deadlines or the bulk of my work. This just doesn't seem right to me. In a time when I'm supposed to be cutting down on stressful situations, the company I work for is creating a mountain out of a mole hill resulting in more stress! What can I do about this?

Sorry to hear of your health condition. However, first thing is to clarify that you are not disabled under the Americans with Disabilities Act (ADA) and the company is not obligated to provide you this reasonable accommodation.

However, you should go ahead and couch your request under the ADA. In writing ask the company that you need this reasonable accommodation of one day of working from home and see how they respond.
