Legal Question in Personal Injury in Georgia

A storage door fell on my feet causing a foot strain in a store and their insurance company denied the claim. They stated that out of all their stores an accident like this has never happened before, so they dont believe that they are responsible for my injury. So who do I take to court the insurance company that denied the claim or the store whete the accident occured?

You sue the store, and of course you still have to prove liability (ie it was their fault and not yours) and damages. Exactly how much are your medical bills for a foot strain, and how will that compare to the time and expense of a lawsuit that could last for a while?

My advice is to have your case evaluated by an attorney. It sounds like you have a claim but the value of your injury is unclear.

Besides if the insurance company denied your claim, presumably the underlying company will do so also. Thus, you are not helping your case by haggling with the adjuster on your own.

It sounds like you already made a huge mistake. People who pursue injury claims without counsel usually get denied, and when they do get offers they get far less than when they have a lawyer. Sadly, the harm is already done. In talking without a lawyer, you usually diminish the value of your claim by not knowing how to do a proper demand package and when NOT to make statements.

Nonetheless get counsel now. If you have a good claim, and a lawyer can evaluate that, possibly a lawyer can salvage your case for you.
