collection for debt against deceased person

I need to know if in the State of Idaho, if we are obligated to pay a credit card debt that is owed against someone that has died, that did not have any assets. I have been paying on the account since his passing but now they want payment in full. He was the only one on the account.

If the account was not yours, you have no obligation to pay it.

You did the credit card company a great kindness, but the thing you need to ask local counsel is can you now be FORCED to pay, whereas before you did so out of guilt or whatever.

One thing you can do is simply not pay and see what happens. They can't impact your credit, they can't sue you without a showing you are liable.

If you're really unsure, simply spend 30 minutes with a lawyer (or call legal aid) and find out. Legal aid attorneys tend to know this stuff off the top of their heads, because it is a fairly common question.
