Legal Question in Family Law in Illinois

agreement in divorce degree

In my divorce decree I agreed to one extra activity per child to split in half. Since the divorce I lost my job and I can't pay for hockey,gmnastics,etc.. How can a judge order me to pay more than I make? I'm being ordered to pay for this and I can't even afford my bills, and I'm being asked to pay more than I make. Can this be modified.

Re: agreement in divorce degree

Yes, anything related to child support, visitation, or maintenance can be modified, Assuming that you lost your job through no fault of your own, you should go to the court having jurisdiction over your divorce agreement and file a Motion to Modify or Abate Child Support. This is something you can generally do on your own without using an attorney but you must follow the procedural guidelines. The court clerk should have a copy of these for you.
