Legal Question in Civil Litigation in Illinois

Neighbor harrassment

Over the last two years my neighbors have continually harrassed us by taunting us,slandering us to other neighbors, trespassing on our property, notifying the attorney handling the sale of the estate house next door that our fence is over the property line, and finally by calling animal control on us to complain that we have one too many dogs (dogs which are NOT nuisances-no barking, inside all the time except when let out to go potty, yard always kept pristinely clean). They have bought the house next door for their daughter and I fear it will only get worse now. I feel as if I am under siege in my own home. I cannot even go out in the yard. Do I have any recourse against these people to get them to leave me alone? Unfortunately moving is not an option at this time. The situation has caused me so much distress that I have had to start seeing a therapist and go on antidepressants and antianxiety medication.

Re: Neighbor harrassment

If this is really so bad that you are suffering severe mental anguish, you might consider suing them for intentional infliction of emotional distress or trespassing and try to get a court order with teeth.

But because moving is not an option, and you are not going to be able to force them to move, your best bet is to consider mediation. For better or for worse, these are your neighbors and you need an agreement that will allow you to live near each other in relative peace.

Our law firm offers reasonably priced mediation services that can help you and your neighbor deal with all of these issues at one time and draft a written agreement that both parties participate in writing, so there is a much better chance of everyone following through the first time.
