Legal Question in Employment Law in Illinois

One of my employees admitted to stealing $4400 from my restaurant. She has been charged with a misdemeanor crime - 1st offendor, In Illinois this is common practice. she has accrued 4.5 vacation days - do I have to pay her these days legally?

Yes, I would say you do. You might be awarded restitution by the Court--that is the correct avenue to attempt to recoup your losses. Otherwise, you can sue her in small claims. I would not recommend giving her the opportunity to file a complaint for failure to pay her amounts which are earned.
