Legal Question in Landlord & Tenant Law in Illinois

tenant not paying rent

We rent a house and our tenant has not paid December rent, January rent is now due. Her lease is up at the end of February. How do we get rent that is due. She says she's moving out it a week. Can you tell me the steps I have to take to get the rent that's due and also get her out of the house.

Re: tenant not paying rent

Hello and Happy Holidays. You should

give your tenant a 5 days notice. If

she does not pay in 5 days you can file a forcible detainer complaint in

the Circuit Court for her to be evicted. This is quite an involved

process and the slightest error could

result in the tenant being able to stay longer. I suggests you get a

lawyer. You definitely want to get

her out as soon as possible. I will

be happy to discuss this with you further and in more detail.
