Legal Question in Medical Malpractice in Illinois

Chiropractor Possible Malpractice?

my grandpa was seeing a chiropractor for 3 months for what the chiro told him was a ''pinched nerve''. he told the chiro over and over again that his pain was worsening and he was very short of breath. one day after treatment, he called the doctor in and asked him to help him because he couldn't breath. the doc ended up giving him a back brace. after a while, the family made my grandpa go to a real doctor just in case. the real doctor told him he had none of the symptoms of a pinched nerve at all. two weeks later, he was dead of cancer. turns out, he had lung cancer. the chiro never referred him to a real doctor and continued doing treatments for symptoms he didn't have. my grandpa just passed 14 days ago. the family is devestated. is there anything we can do to this guy? we feel like he torchered my grandpa just to make a buck!

This sounds like the chiropractor may have made a very serious and unfortunate error. Please call my office at 312-357-1431 for a free consultation, so that I can gather more facts and possibly be of help to your family. Thank you.

Re: Chiropractor Possible Malpractice?

It is impossible to know whether the Chiro has done anything wrong or whether he or she has deviated from the standard of care in the community in which he or she practices. Of course, there are many issues to consider and from what you have said, it may seem that you may have a case of negligence. The question remains as to whether the unfortunate event would have happened with or without the intervention of the Chiro--that is a possibility that needs to be explored. An attorney well versed in the area of negligence should take a look at the records and the surrounding circumstances in order to give you a better assessment of the possible cause of action. You should consult with an attorney at once and before having spoken to any representative of any insurance company of any sort. The adjusters from the insurance companies are not your or anyone else's friend. You can call my office or you can call the CBA lawyer referral service if you need help finding a qualified attorney.

I hope this helps,
