Legal Question in Personal Injury in Illinois

Hi, On friday February 05, 2010 at approximately 530pm I was leaving some one's property which hapenens to be a real estate company, as I was making my way down the steps I fell on my backside hurting my lower back and left leg, there was a ladie and a young girl that witnessed the fall they helped me up as they were helping me one of the building mangers of the building I live in whom happend to be at the office came out and asked if I were ok while I was talking to him the ladie and the young girl got away befor I could ask them there names and get a phone number after she helped me up she pointed out the 2 bags of unopened snow salts in the conner and said "look they haven't even put down any salts yet'. I realize all the mistakes I made at this point like not getting her info and trying to make it home on my own, so my question to you all is do I still have a case?

A case for what? The basic recovery would be medical/related costs you incur and lost work compensation if any. So did you have to go to a doctor when it happened? Have you gone to a doctor yet? Did you ever go for Xrays? Did you buy any drugs (via scrip or OTC) for pain? Did you lose work? Are you still in pain now? What was a building manager of the building you live with doing at the real estate company's office at the same time or was it just a coincidence? Did he witness the slip? At 5:30 pm it was getting dark, right? The time when things that were wet start to freeze up but might not be? How much ice was there? Enough so that anyone would notice? Were the steps lit yet? Was there any lighting? These are all questions and yes the further away from the incident and the less you have the more difficult it will be.

Most PI attorneys will give you a free consult to see if they'll even take a case. I suggest you talk to one. I'm here only to encourage you to do so, so that you present all of the information needed to form any kind of reasonable opinion.

You do not give enough information so as to enable me to give you an proper answer. You do not say anything about injuries. Are you injured? If so, what are your injuries? What are your treatment plan? In order to have a case, aside form first finding out whether the owner of the property was at fault for anything, you have to show that you have been injured in someway. If, by the grace of God, you have not sustained any injuries then you do not have a case--since first you have to show damages in order to then find out whether anyone other than you is responsible for the expenses you may incur as the result of that injury.

If you want to talk more about it, you may call my office, I will be more than happy to go over it all with you. If you call, please be prepared to give an answer to the questions regarding your injuries and treatment, if any.

I hope this helps-
