How is compensation amount calculated for DV Act,2005 case?

Marriage registered in Delhi under HMA,1955.

I'm the victim of mental & physical harassment by NRI husband & inlaws.Hubby deserted me almost 3 yrs. back.I don't know where he is living now

I tried for reconciliation in CAW cell but he still refused to take me back.So I have filed DV Act case in Feb,2009.They all refuse to accept notices.They have a lawyer but he never comes in hearing.

.Inlaws in India.He's the only child;no issue.Earns more than 1 lakh monthly.Enjoys a luxurious life,but pretends 2 B poor

I have no proof of his salary & financial status.

Earlier he said(when I was on Indian vacation)that he will call me after finding a house,as he changed his job.This went on for 1.5 yrs.So I dint collect any proof of all financial losses my parents & I we were facing then.Now I am claiming compensation for all mental trauma,desertion & financial losses.But we have not collected any documents to support financial losses that are so large

How can we claim financial losses now?

And how is the amount calculated?I'm also claiming monthly maintenance,besides compensation for these losses.We are suffering for more than 3 yrs. now.Please help.

this is infact a mental trauma and physical hardship of grave nature. why is your complaint not disposed off within 60 days...as DV act says so. there must be some negligence from your side by way of legal representation. you may send in all the details of your case and i would be able to suggest you the faster way out.

You need to make efforts for collecting complete details without which you may not be able to pursue your case properly.

You may also find out details of parents' assets and their sources; if your husband contributed towards family kitty, you may claim maintenance out of that.
