Child Custody

I have a 5 year old grandson that has lived with either us or his dad most of his life. His mom only wants him when she wants him. The problem is, is that my son's name is not on his birth certificate nor is he the blood father to this child. We have been with him since birth. He is now going to school from dad's house. The mother cannot financially nor morally take care of this child. She is also a drug addict and recently got out of jail for assualt and battery. Whenever he's with mom he always comes back with the bad habits he's picked up there. Example: When he was 4 years old he came back to my house and tried to french kiss me and hump me....that's when I knew he had seen someone having sex. This is just the tip of the iceberg. What rights do we have to make sure he is safe and that his dad can raise him without the awful influences of his mom? I don't want to cut her out of his life, but she needs supervised visits. We have too long been captive of her whims and awful lifestyle. Please help us!

You or your son can file for custody under Indiana law. I strongly suggest that you contact a family law attorney as soon as possible.
