Legal Question in Family Law in Indiana

Statue of limitations Re: Paternity

RE: Is there a time limit as to how long a mother can go before requesting paternity Tests?*Both parents were residents in Indiana*The child was born in In.*The father never was listed on birth certificate, nor were paternity tests done.* The child is now 8yrs. of age, the mother and child just recently moved to Florida * Mother is now threatning to sue for child support(we voluntarily pay med. Ins., and have since child was born), We understand In. laws to be 5yrs. from date of birth, what state laws will they abide by in this case seeing how Florida law is different?

Thank-you

Re: Statue of limitations Re: Paternity

If the mother waits until after the child is age 2, then the father is not on the hook for BACK child support. But he can be on the hook for child support from the date of the filing of the petition to establish paternity forward.

Hope this answers your question.
