Legal Question in Credit and Debt Law in Kansas

I just received a bill for a medical laboratory test that was done almost a year ago. The nurse practitioner ordered it, not a doctor. The lab states in the bill that their service was provided on 2/18/09. I got this bill today, 2/12/10, thats a few days shy of a year. I called them and they said my insurance company finally got them an EOB on Jan 30th, 2010. That's why they are billing me now. It's not the money, $7.69, its the principle. I say they eat it. Obviously, I'm no J.D. Any suggestions?

The one year period you mention is well within the statute of limitations. You may have an argument atht you did nto approve of the lab doing the work. This might work, but you may have to litigate to make it. Beware, many people sign agreements to services that include attorney fees or collection cost reimbursement without realizing it. You don't want to pay hundreds of dollars in as faield attempt to save $7.69 do you? It is unlikely that this small bill will ever get to an attorney, but may get you multiple letters and calls from a collector.

Good luck
