Can I be given a DUI if I wasn't driving?

I was parked with a friend on the street right outside of someone's residence. The cops pulled up behind me because they suspected me of hitting a sign somewhere in the area. I had no open containers, the keys were not in the ignition but they were in the vehicle in the console. They asked me to do a field sobriety test and a PBT but i refused both. I was charged with DUI. Can I beat this?
