Legal Question in DUI Law in Kansas

DUI and Failure to Appear?

Hello all,

My father's girlfriend had a DUI in Kansas two years ago. She failed to show in court for this violation at that time. She is now wanting to try and clear it up, so she called and they gave her a new court date. We were all just wondering what kind of possible punishments we can expect for a first time DUI, with a Failure to Appear. Will the warrant for the failure to appear be taken care of when she arrives for her new court date? Will her fines and/or possible jail time increase? Also, is there a statute of limitations on DUI charges? Thanks much.

Re: DUI and Failure to Appear?

The minimum sentence for a first time DUI in Kansas is 2 days in jail and a $500 fine. She will also be required to get an evaluation for drug and alcohol problems and follow through on the recommended education or treatment. I assume they have already lifted the warrant or will do it when she shows up for court. The judge could increase the sentence because of the failure to appear. The statute of limitations is 2 years, but that means they have 2 years to charge her. They did that.

There are many possible defenses to DUI so I strongly recommend you talk to an experienced DUI lawyer. If her case is within a reasonable drive of the Kansas City area, give me a call.
