supervised visitation

My husband and I are getting a divorce. He has been very emotionally and mentally abusive to our children and myself. Our daughter 6 doesn't want to go anywhere with him

if I won't be there. All her life he has denied he was her father. Can I get supervised visitation. I am afraid he would continue his abuse if they were alone with him.

our son is only two and doesn't understand but our daughter is afraid, will her wishes be heard or just ignored?

You have a right to request supervised visitation.

You are going to have to go back to the circuit or family court and make a motion requesting it. Within the motion you will have to state the specific reasons why the supervision is needed. You should also request that the Court appoint a Guardian Ad Litem (GAL) to represent the best interests of your child. The Guardian Ad Litem (GAL) would assist in evaluating the situation and make a recommendation to the Court.

Chances are the GAL may make recommendation for counseling in addition to the supervised visitation. Again, you probably need to seek out an attorney be specific with your fact situation.
