Legal Question in Civil Rights Law in Louisiana

Unauthorized Entry into hotel room

The hotel staff of a top hotel chain provided access to another guest into our room when my pregnant wife was sleeping alone during middle of the night. They said it was due to a mistake in their computers? Is it possible for me to take any legal action against them? We had to cancel our vacation as my wife was scared and wanted to go home.

Re: Unauthorized Entry into hotel room

Dear LawGuru Friend,

If your question is whethter or not you can get any money out of this if you pursue a legal damages claim, my guess is that YES you can. How much? Not a lot! If you insist on a lot, they will balk, causing you to file suit and may even balk long enough to make the matter go to trial and be tried before a judge or jury. Think of how you would view this case if you were not involved but were on the jury and having to make a decision of how much money you would allow somebody else's wife who had the same thing happen to her. The hotel is responsible for its computer. It made the mistake and it legally "owes" a sum of money to compensate for whatever damages it has caused somebody. If you were on the jury, would you consider it "reasonable" that some other couple "had to cancel" their vacation. Would you consider it "reasonable" that this incident would have "scared" some other guy's wife; and, if so, just how much money would you recommend the other guy's wife be paid to comnpensate her for her damage (fear)? Yes, if you make a claim, you can receive compensation. At least that is my analysis, my educated guess. I know if you came to me with that case, I would take it; but I would tell you going in that "nothing ventured, nothing gained," and that I feel I could get you "something", "some money"; and that the more I would get you the more I would make; but I would make no promises as to the amount I could get you. This is about the best analysis of this situation I can give you. Good luck to you and her!

With kindest regardss, I am

Sincerely,
