Legal Question in Workers Comp in Louisiana

Bankrupt

My husband was killed at work a few years ago and I am drawing monthly workmen's compensation. The company has contacted me a few times with offers, but I have declined thinking them unfair. The last time we spoke they said to me, ''you know if we go bankrupt you will lose it all.'' This has started me thinkinm maybe I should settle, for loseing it all would ruin me. I have asked this of several people but am unable to get an answer. Is this true? If this company goes bankrupt will my payments stop? Are they insured in no way?

It is difficult to imagine a company being uninsured, unless it is a very small one or a huge company who prefers to be self-insured. Worker's compensation never pays at the same level as if a person were injuried or killed by someone else's negligence in an auto accident. You should contact an attorney so he/she could look at the facts surrounding your particular case, since you may have rights you are not aware of.
