Legal Question in Personal Injury in Maine

if two people have lawsuits against the same company for the same thing can one take a settlement if the other takes the company to court?

Your question is vague and the specific facts could greatly affect the usefulness of this answer, but if I assume the question relates to 2 people who have separate personal injuries from the same accident and are both proceeding against the same insurance coverage, then the answer is one can settle and the other can proceed so long as the company still wants to settle with just one. Settlement is voluntary and in many situations the company does not want to settle with just one party. Often times all parties will agree to meet with a mediator and discuss all options to resolve the matter. I have had excellent success in mediation with cases that I did not think would settle.
