Legal Question in Credit and Debt Law in Maryland

How much can creditor garnish from Maryland worker?

Does anyone know the limitations on

garnishing wages of a Virginia resident

working in Maryland for a Maryland

employer?

What is the formula for what can be

collected?

Specifically, does the debtor's court-

ordered obligation to pay child support

from out of the salary act as an exemption

reducing the amount of wages that can be

garnished? Similarly, the debtor maintains

a second residence in the state where the

child lives as an obligation necessary to

effect visitation rights. Can the debtor

claim his costs of a second residence as

any kind of exemption that can be claimed

because it is part of child custody?

Re: How much can creditor garnish from Maryland worker?

In Virginia I believe that there is a garnishment limit of 25% of the debtor's net salary. Net salary is what's left have all mandatory/required deductions.

The court-oredered child support would fall in the category of mandatory/required deductions.

The costs of maintaining a second residence for purposes of facilitating visitation would most certainly not qualify as some kind of additional exemption from garnishment.
